Louboutin red sole Vs. Ysl
YSL spring summer 2011 collection features suede pumps in Purple, navy blue, green and red each with its matching sole so, the purple pumps have purple soles, the green pumps have green soles etc... but it is the red sole of the red pumps that made Louboutin take action against YSL. The " Telegraph " wrote: "Yves Saint Laurent's spring 2011 collection features a pair of red suede shoes with matching red soles, which have prompted Louboutin to file court papers in New York suing them. The collection also features purple shoes with purple soles, navy with navy soles and green with green soles, but it's the red soles that have sparked the legal action".
Silly i know but true knowing that it is not the first time YSL makes such shoes and knowing that the shape and form of the Louboutin shoes and patent sole is distinctive and there is no way to get confused between the 2 labels' designs.
The lawsuit says: " Defendants use of red footwear outsoles that are virtually identical to plaintiff's Red Sole Mark is likely to cause and is causing confusion, mistake and deception among the relevant purchasing public as to the origin of the infringing footwear. The location of the bright color on the outsole of a woman's pump is said to provide an alluring 'flash of red' when a woman walks down the street, or on the red carpet of a special event. " also in the Lawsuit one can read that back in January Louboutin learned that YSL was selling his red soles pumps at "Saks Fifth Avenue", "Barneys New York", " Bergdorff Goodman", "Nordstrom", and "Neiman Marcus". and ever since, the designer repeatedly asked YSL to stop selling the shoes. Also in the Lawsuit, Louboutin is naming his fans and in the list, the cast of "sex and the city", "Gossip Girl" and " Desperate Housewives" and i am not sure who's the desperate in here.
A 27 pages Lawsuit that leaves me wondering what is the real reason behind Louboutin's act.
2011 is so far the year of disappointment in the world of fashion. Lately, Balmain fired his creative designer Christophe Decarnin as well.
Is it the fight of red Souls in the world of fashion??
